If you are a current temporary patio licence holder and you would like to extend your patio through the winter, you must contact the City by email firstname.lastname@example.org by September 20, 2021, to verify whether you intend to occupy the Licence Area for the Winter Season.
You are not permitted to occupy the Licence Area between the dates of November 1, 2021 and April 30, 2022, unless you have contacted the City. Occupation of the Licence Area without a valid License of Occupation is a breach of the City of Edmonton’s Traffic Bylaw 5590.
Depending on what you plan for your winter patio, it may not be possible to continue within the scope of the Temporary Patio Extension Program as you did over the summer months.
Temporary Outdoor Winter Patio Options
You choose not to operate your patio in the winter. You must take down your patio by October 31, 2021. Commencing November 1, the City will start to remove all existing traffic controls from the License Area.
The removal of the patio must ensure no tripping hazards are left behind, any defects or cracks left in City infrastructure are repaired to the City's standard and if extensive damage is present, replacement of the concrete is completed with City approval.
You choose to set out tables and chairs on the sidewalk on nice weather days, and are able to maintain a minimum 2m of pedestrian space on the sidewalk alongside your tables and chairs. We will ask you to complete this form, allowing you to occupy the sidewalk space until April 30, 2022.
You want to set up structures that are not included in the guidelines, such as a large tent, or wind protection, or you intend to place part of your patio in the roadway while maintaining a minimum 2m of pedestrian space on the sidewalk.
The City will not be permitting the redirection of pedestrians into the curb lane for the winter season, and will be evaluating each proposed patio on a case-by-case basis. The City may require you to undertake additional changes to the design and operations of the sidewalk cafe, including, but not limited to, changes to the layout and type of traffic control devices. You may be required to apply for permits (fees apply) and will require a Licence of Occupation in order to operate in the winter. It is important that you do not set up any structure until City approval is granted.

If you fail to contact the City prior by September 20, 2021, the City will presume that you do not intend to occupy the Licence Area in the Winter Season. You will be obligated to completely vacate the Licence Area by no later than October 31, 2021, and you will no longer have the right to occupy the Licence Area during the Winter Season (November 1st to April 30th) without the express written permission from the City. Occupying or using the Licence Area without the City’s written consent is a breach of contract under the Licence of Occupation and a breach of the City of Edmonton’s Traffic Bylaw 5590 and subject to enforcement.
