Construction of a garden suite, garage suite or secondary suite requires development and building permits be applied for before construction begins.
About the Service
Depending on whether you are constructing a secondary suite (built within the home), a garage suite (built into a garage that is separate from the home) or a garden suite (built as a separate building from the house and garage), different zoning regulations and application processes apply.
Secondary suites can be created in most residential zones of the City, although specific development regulations apply. In most low-density residential zones, they are considered to be a permitted use, while in other residential zones, they are considered to be a discretionary use.
Garage and Garden Suites
Garage suites and garden suites are allowed only on a discretionary basis under the Edmonton Zoning Bylaw, and only in specific locations within most residential zones.
What is a Permitted Use and Discretionary Use?
- A Permitted Use means the proposed construction will be approved because it meets all of the zoning bylaw requirements.
- A Discretionary Use means the application does not meet all of the zoning requirements and therefore, the application will only be approved if the Development Officer approves it and no appeals are received through the notification process. In the notification process, a public notice with the application details is placed in the paper and all property owners within 60 meters (200 feet) of the address are notified of the application.
The purpose of providing the notification to these parties is to provide an opportunity for people who may be affected by these discretionary decisions an opportunity to register an appeal regarding the proposed construction or use of that property.
