Condominium Conversions
The Condominium Property Act, RSA 2000 provides an opportunity for landowners to convert existing buildings into condominiums. The act requires the City's approval prior to registration of such conversions.
Plan Review
Unlike bare land condominiums, which are dealt with much the same way as subdivisions, the City's approval is indicated by the City Clerk's signature on the condominium plan. Prior to signature, an Alberta Land Surveyor submits the condominium plan to Sustainable Development for review.The review consists of comparing the plan to the development permit issued when the building was constructed to ensure the number of suites and the on-site parking required are consistent between the development permit and the condominium plan.
Following this review, the City Clerk signs the condominium plan. The Alberta Land Surveyor can then submit the plan for registration through Alberta Land Titles Office.
A fee is charged for this service. It takes approximately 5 working days to review the plan and attain the signature.
Requirements
In order to comply with Section 10 (1)(b)(ii) of the Condominium Property Act, please be advised that the following information is required:
- Complete the Application for Condominium Conversion.
- Submit 4 copies and 1 digital of the condominium plan prepared by a registered Alberta Land Surveyor in accordance with the Condominium Property Act and the Condominium Property Regulation (Alberta Regulation 168/2000).
- Submit the condominium fee payable to the City of Edmonton. The fee is $40 per unit for each residential, commercial or industrial unit and $20 per unit for each underground parking stall.
Converting surface parking stalls is treated as a bare land condominium and is deemed to be an application for subdivision. An application for subdivision to create the "bare land parking units" must be submitted through the City of Edmonton's online subdivision application.
- Submit a copy of the parking plan that was approved by the City of Edmonton in association with the development permit. Copies of the approved parking plan should be available for buildings constructed within the past 10 years and may be obtained from the owner, the builder, the architect or Sustainable Development.
- In the event that the building is older than 10 years or the approved parking plan is unavailable, the applicant is required to prepare and submit a parking plan identifying the number of parking stalls, the width and length of the parking stalls, and the width of the drive aisles in association with a list of the number of bedrooms per unit.
- The above requirements shall comply with the effective zoning legislation when the development permit was issued.
- It should be noted that visitor parking stalls shall be identified as common property.
- Submit a copy of the Certificate of Title of the property issued within 30 days of receipt of the application for condominium conversion.
