Compliance Certificates - Residential & Commercial

A Compliance Certificate is confirmation from the City that all buildings and structures identified on the property have met the regulations under the Edmonton Zoning Bylaw, and have the appropriate building permits.

 

About the Service

What is the Process?
The Alberta Land Surveyor's Real Property Report is reviewed by a Development Officer to see if it meets the current zoning bylaw regulations and that building permits have been applied for.

The Real Property Report must be prepared and signed by an Alberta surveyor. This document must show:

  • all existing buildings on the property;
  • the distances from existing buildings to property lines;
  • the date of the survey,
  • the address and legal description of the property and,
  • it also must be stamped with the surveyor's seal.

Once reviewed, the applicant will get one of the following:

  • If everything complies with the current zoning bylaw the real property report is stamped by the Development Officer indicating everything is in compliance up to the date when the real property report was done for that property.
  • If everything complies but the property does not meet the current zoning bylaw requirements (eg. Property is located in an older neighbourhood and the buildings had permits applied for and were built according to the prior zoning bylaw requirements but they don’t meet all of the regulations in today’s bylaw) the applicant will receive a letter indicating the buildings are “Non-conforming” to the current Zoning Bylaw. In this situation, the appropriate permits are in place and no further action is required.
  • If the appropriate permits or encroachment agreements for some of the structures have not been applied for, the applicant will get a letter indicating what the issue is and what future actions the applicant must take to correct the issue. (eg. Apply for an encroachment agreement, remove the structure, apply for permits, etc).
  • If the applicant applies for the required permits, encroachment agreements etc. within 6 months from the original letter which identified the issues, they can apply for a  "Re-Stamp". If they apply outside the 6 month time period, a new compliance request is required.

Fill in the Compliance Certificate Application form.

You must also include:

  • Two copies of an Alberta Land Surveyor's Real Property report (RPR). The RPR cannot be faxed, e-mailed, spliced or altered.
  • If possible, provide one copy of the Land Title Certificate. Providing us with this document helps speed up the application process of determining whether an encroachment agreement is required for any structures located on a Utility Right of Way.

Fees

What is Regular versus Express Service?
There are 2 service options that the applicant can choose from:

  • Regular – All applications received on a particular day are processed together as a group. The date they will be ready for pick up will vary depending on the volume of work the area is experiencing. Average length of time is 10 working days, however this time could be longer if work loads are particularly heavy.
  • Express – The applicant has the option of paying an additional fee to ensure their compliance application is reviewed and a response done within 3 working days – not including the day we receive the application in our office.

Compliance Certificate Fees for Single Detached, Semi Detached or Duplex Homes (must be 2 residential units or fewer on the property)
