- 1. How does the City sell its residential lots?
When the City first introduces a new phase of a subdivision, it is usually offered by way of a "lot draw". The lot draw will be advertised in the newspaper, in addition, all people who subscribed to the online notification service or have requested to be added to the mailing list will be notified at least 2 - 3 weeks prior to the draw. Any individuals or business wishing to purchase a lot may make one application to participate in the lot draw by registering during the timeframes allotted prior to the draw.
- 2. Is there a registration fee for the Lot Draw?
At the time of registration a certified cheque or bank draft made payable to The City of Edmonton for the sum of $4,000.00 is required. The $4,000.00 is applied towards the required deposit for those successful at the "Lot Draw". If the applicant selects a lot but does not enter into the Sale and Development Agreement, or cancels the sale, the $4,000.00 is forfeited to the City of Edmonton. If the applicant is not drawn or is drawn but does not select a lot, the $4,000.00 is returned.
- 3. How does a Lot Draw work?
In a lot draw, all registration forms of both companies and indivdiuals are placed into a drum and as the names are selected at random, that company or individual would select a lot based on what is remaining. This continues until either all lots are sold or there is no further interest.
- 4. Can an Individual apply to purchase a lot as a homeowner?
Yes, however, only one application per family will be accepted and participants must be at least 18 years of age. Additionally, at the time of registration all individuals registering must do so in person and provide picture identification which reflects the current mailing address. Each registrant will be required to complete a Statutory Declaration which states the following:
- the name, address, home and business telephone numbers of the applicant;
- that the lot will be for the applicant's own personal use;
- that the lot chosen by the applicant will not be used for speculation or resale;
- that the applicant has no financial interest in any other application being made for these lots (i. e. one per family);
- all applications are subject to review.
"Family" means the immediate family (spouse, father, mother, children) who have resided in the same residence as the applicant at any time within three (3) months immediately preceding the date of the lot draw.
NOTE: The name(s) appearing on the registration form will be the name(s) used on the Sale and Development Agreement.
Should more than one person per household (family living at the same address) register for the "Lot Draw", ALL of the registrants from that household will be DISQUALIFIED.- 5. Can an individual also make application to purchase a lot as a company?
- No, you may either apply as an individual or company, but not both. Indivdual applicants should take note that if they purchase a lot as a homeowner, they cannot assign or transfer that lot to another party. The individual is expected to fulfill all terms of the Sale and Development Agreement.
- 6. Does the applicant have to be present at the "Lot Draw"?
Yes, registered applicant(s) identified on the registration form must be present in order to select a lot if drawn. Powers of Attorney or agent representation will NOT be accepted.
- 7. Is GST payable on the purchase price?
Yes, unless you are a company, in which case you must provide the City with a GST number and complete a Statutory Declaration that is enclosed with the Sale and Development Agreement stating that the company is registered and in good standing. All individual applicants must pay GST. For information on GST rebates please contact Canada Revenue Agency.
- 8. What are the general terms of sale?
- The deposit is 15% of the lot price (plus GST) if applicable, less the $4,000.00 paid at the time of registration;
- No interest will be charged for 5 months from the possession date;
- Payment of the balance outstanding is due 5 months from when possession of the lot was granted to the buyer (the closing date);
- All overdue payments will be charged simple interest at a rate of 18% per annum calculated from the closing date until payment is received;
- Lots purchased by homeowners/individuals are to be used for the construction of their personal home.
- Within 90 days of the possession date, all successful applicants will be required to have the following items complete (the soil condition):
- House plans must be approved by the City's designated consultant, Windward Landtec (see Brintnell Design Guidelines for a list of items required to be submitted for approval);
- Make application to the City's, Planning and Development Department for the Development Permit and Building Permit;
- Have a qualified geotechnical engineer inspect the soil at the excavated depth and 3 metres below at the corners of the excavation prior to pouring any concrete. The purchaser is to provide the City with a copy of the geotechnical engineer's report, verifying that the soils have adequate bearing capacity and/or stipulating any construction recommendations and specifications due to the presence of bedrock and/or engineered fill (A structural engineers report may also be required).
Should the soil condition not be met within 90 days of the possession date, the sale will be canceled and the lot returned to the City to be resold. Any costs to return the land to its original state will be deducted from the monies received and the balance will be refunded (less the monies paid at the time of registration).
- 9. Are there design guidelines in this subdivision?
Yes, to ensure compliance with the design guidelines, the purchaser under a Sale and Development Agreement is required to deposit with the City a $2,000.00 performance fee and executed Option to Purchase. In addition, ALL house plans must be reviewed and approved by the City's Designated Consultant (Windward Landtec Inc. ) prior to application for a development and building permit. The performance fee will be returned to the Buyer upon confirmation of compliance with design guidelines.
All purchasers are required to contain excavation dirt from the basement and any construction debris entirely within their lot property lines.- 10. Is there a specified timeframe in which the construction and landscaping must be completed by?
Yes, within 18 months of the possession date, the construction and landscaping must be completed in accordance with the Architectural Controls for the subdivision. Any completion deadlines that fall within the period from November 1st to June 30th shall be extended to the immediately following July 31st
- 11. What happens to the lots not sold in the lot draw?
Lots not sold at the lot draw will be available for sale on a first-come, first-served basis at our office starting at 11:00 a. m. the morning following the draw.
